Terms of Service for Cryptofanz

1. Introduction

1.1. These Terms of Service (“Terms”) govern your access to and use of the Cryptofanz website, platform, and services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
1.2. Cryptofanz is a blockchain-based platform that empowers content creators in the adult entertainment industry by providing a secure, decentralized, and privacy-focused environment for monetizing their content.
1.3. The Service is operated by Cryptofanz Ltd. (“Company,” “we,” “us,” or “our”), registered in Gibraltar.

2. Eligibility

2.1. You must be at least 18 years old to access or use the Service. By accessing or using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
2.2. You may not access or use the Service if you are located in a jurisdiction where the use of blockchain technology or adult content is prohibited or restricted.

3. User Accounts

By uploading content to the Service, you grant Cryptofanz a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the content in connection with the Service and Cryptofanz’s business.
4.2. You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish and monetize the content you upload to the Service.
4.3. Cryptofanz respects the intellectual property rights of others. If you believe that your intellectual property rights have been infringed, please contact us at legal@cryptofanz.net.

5. Prohibited Activities

5.1. You agree not to use the Service to:
a. Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable;
b. Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity;
c. Engage in any activity that interferes with or disrupts the Service or the servers and networks connected to the Service;
d. Attempt to gain unauthorized access to any portion of the Service or any other accounts, computer systems, or networks connected to the Service;
e. Use any robot, spider, scraper, or other automated means to access the Service for any purpose without our express written permission;
f. Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful;
g. Violate any applicable local, state, national, or international law or regulation.

7. Content Moderation

7.1. Cryptofanz employs advanced machine learning (ML) and artificial intelligence (AI) technologies to automatically detect and disallow unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable content.
7.2. Our content moderation system is designed to create a safe and welcoming environment for all users while maintaining the integrity of the platform.

8. Fees and Payments

8.1. Cryptofanz charges fees for certain features of the Service, such as content subscriptions and tips. By using these features, you agree to pay the applicable fees.
8.2. Payments on the Service are made using the S3KZ token, the native cryptocurrency of the Cryptofanz platform. You are responsible for obtaining and maintaining any equipment and services needed to access and use the S3KZ token.
8.3. Cryptofanz reserves the right to change its fees and payment policies at any time. We will provide you with reasonable notice of any changes to our fees and payment policies.

9. Termination

9.1. Cryptofanz reserves the right to suspend or terminate your access to the Service at any time, without notice, for any reason, including but not limited to a breach of these Terms.
9.2. Upon termination of your access to the Service, your right to use the Service will immediately cease.

10. Disclaimer of Warranties

10.1. The Service is provided on an “as is” and “as available” basis, without any warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
10.2. Cryptofanz does not warrant that the Service will be uninterrupted, error-free, or free from viruses or other harmful components.

11. Limitation of Liability

11.1. To the maximum extent permitted by applicable law, Cryptofanz shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

12. Indemnification

12.1. You agree to indemnify and hold Cryptofanz and its affiliates, officers, agents, employees, and partners harmless from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Service.

13. Governing Law and Dispute Resolution

13.1. These Terms shall be governed by and construed in accordance with the laws of Gibraltar, without giving effect to any principles of conflicts of law.
13.2. Any dispute arising out of or in connection with these Terms shall be resolved through arbitration in accordance with the rules of the Gibraltar Arbitration Centre.

14. Amendments

14.1. Cryptofanz reserves the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect.
14.2. By continuing to access or use the Service after any revisions become effective, you agree to be bound by the revised Terms.
